As per the decision of His Highness General Sheikh Mohamed Bin Zayed Al Nahyan, Crown Prince of Abu Dhabi, Deputy Supreme Commander of the UAE Armed Forces and Chairman of Abu Dhabi Executive Council, on forming the supervisory committee to oversee the 2014 elections of Abu Dhabi Chamber of Commerce and Industry, the committee, chaired by His Excellency Consultant Sultan Rashid Al Niyadi, a Judge from the Department of Judiciary, held its preliminary meeting and the first periodical meeting with the attendance of His Excellency Mohammed Omar Abdullah, Her Excellency Maryam Mohammed Al Rumaithi, His Excellency Obaid Khalfan Al Dhaheri, His Excellency Mohammed Rashid Al Hamili and His Excellency Dr. Jasem Ali Al Shamisi.
His Excellency Consultant Sultan Rashid Al Niyadi, Chairman of the Supervisory Committee, said that the committee shall supervise the entire process of the 2014 elections of the Abu Dhabi Chamber.
Al Niyadi noted that the committee will coordinate with the Chamber’s Board of Directors to set a date to invite the members of the General Assembly to elect a new Board of Directors. He also noted that the committee shall also coordinate with the management of the Chamber to announce a registration date for the candidates and the period and terms of registrations which will be according to the requirements of the law. The committee will also supervise the list of voters and their data in coordination with the management of the Chamber, as well as supervise the Office of Elections Affairs and its services, specify the voting centers and the process of voting while supervising the voting forms, checking candidacy applications, compatibility with the terms and conditions and rejecting the applications which do not go in line with the terms or requirements of the Chamber’s law.
The judge added that the committee shall supervise the final list of candidates, disclose it and announce the date of waiving the nomination. The committee shall also resolve all objections and grievances in regard to candidates, the election process and its results and specifies a timeframe of such objections. The committee shall also set the rules of the candidates’ campaigns and sets the dates of kicking off such campaigns and their end dates, terms and organizational regulations as well as announcing the decisions for such campaigns. The committee shall supervise the process of voting and announcing the winners while supervising the terms and procedures of voting and receiving the voting results from Abu Dhabi City, Al Ain City and the Western Region.
Al Niyadi emphasized that the committee shall announce the final results of the elections and look into violations that could hinder the election process or following instructions. The committee shall be entitled to ask for documents and necessary data and information on set dates and making decisions in all matters and objections it receives.
According to the directions of the supervising committee, the Abu Dhabi Chamber announced Thursday 12 June 2014 as the date for conducting the first round of elections. In case of lack of quorum (the attendance of a quarter of the members of the General Assembly) an invitation for a second round will be initiated after two weeks from the first round and the meeting will be held on 26 June 2014 regardless of the number of attendees.
The announcement of the elections date came in a press statement by His Excellency Mohammed Thani Al Rumaithi, Chairman of the Abu Dhabi Chamber. In the press statement, he announced the procedures of elections and the terms of registering, voting and their specific dates.
His Excellency Al Rumaithi praised the unlimited support the Chamber receives from His Highness Sheikh Khalifa Bin Zayed Al Nahyan, President of the UAE, and His Highness General Sheikh Mohammed Bin Zayed Al Nahyan, Crown Prince of Abu Dhabi, Deputy Supreme Commander of the UAE Armed Forces, and their awareness in activating the role of the Chamber and the role of the private sector in the economic development process of the UAE in General and the Emirate of Abu Dhabi in particular.
The Chairman said that according to Law No.27 of 2005 the General Assembly shall be composed of all members of the Chamber, yet both attendance and the right to vote are limited to members who have paid their annual subscription fees and that the General Assembly convenes once every four years to vote for a new Board of Directors.
His Excellency explained that Article 9 of the law includes that the Chairman of the Board sends a convocation for a meeting for the General Assembly at least one month prior to its holding; and that the convocation shall be published in one of the local newspapers. The meeting shall be deemed valid only if attended by a quarter of the totality of Chamber members who have paid their annual subscription fees. If the quorum for this meeting is not fulfilled, convocations shall be sent for another meeting to be held at least two weeks from the date of the previous meeting. Thereafter, the meeting shall be deemed valid, regardless of the number of attendees. Decisions shall be taken through the majority of votes of the attending members.
Al Rumaithi said that the law states that each member who has paid his annual subscription fees is entitled to one single vote. If a single License includes more than one person, a letter addressed to the Chamber one week prior to date of elections will define one single mandatory for them. A person eligible for voting may give power of attorney to someone else provided the mandatory is a member of the Chamber, The power of attorney is authenticated by the notary public, and The power of attorney is limited to only one member.
Al Rumaithi mentioned that that the Law of the Chamber states that The Chamber is run by a Board of Directors consisting of 21 members of whom six, including two women members, are appointed by virtue of an Emiri Decree as well as 15 elected members, two of whom are foreigners who shall be elected by the Chamber's foreign members, and that the members stay in the Board for a four-year term.
His Excellency the Chairman announced the registration date for the candidates starting Sunday 30 March 2014 until the end of the working hours on Sunday 27 April 2014 and that no applications will be accepted after the set date. He noted that registration applications are available at Office of Elections Affairs in the 2nd floor of the Chamber’s Tower.
His Excellency also spoke about the terms of registration and voting saying that the law states that the Board Member Candidate should be registered as member of the Chamber and having paid the entire annual subscription fees, have practiced commercial or industrial business for no less than three consecutive years, by virtue of a Commercial/Industrial License, enjoy a full legal capacity, good reputation and being free from criminal indictment, be not less than 21 calendar years of age, and have a business either registered in his own name or be a partner therein.
